Gambling Laws: A Deep Dive

This state offers a wealth of gambling opportunities compared to its relatively small population (2.94m). You can learn more details on these gaming options and associated legalities below.

Land-Based Casinos

Kansas features five commercial casinos and six tribal gaming venues.

Both types of casinos can offer Class III gaming, which includes slot machines, blackjack, craps, roulette, and more.

Hollywood Casino at Kansas Speedway is the state’s largest casino, featuring 2,000 slots and 40 tables on a 100,000-square-foot gaming floor.

Kansas Star Hotel Event Center runs a close second with 1,850 slot machines and 50 tables. Prairie Band Casino & Resort is the biggest Kansas tribal casino, offering 1,200 slot machines and 31 table games.

Horse & Dog Tracks

The Kansas Pari-mutuel Racing Act legalized wagers on horse and dog racing in 1987.

Eureka Downs and the Woodlands racetrack began offering pari-mutuel betting in 1989, while Anthony Downs joined them in 1992. All three tracks have since closed, ending pari-mutuel wagering in the state.

The Woodlands was the last standing, offering horse and dog racing until shuttering in 2008.

It received a lifeline in 2007 when the Expanded Lottery Act allowed racetracks to feature video lottery terminals (VLTs).

However, the Woodlands had to pay a 40% tax rate versus 22% for casino slot machines. The racino could not compete with this handicap and gained no advantage from VLTs.

Bingo, Lottery
and Charitable Gambling

Charities, churches, fraternal organizations, educational entities, and veterans groups can apply for a charity gaming license.

They must obtain separate licenses to offer bingo and raffles ($25-$100 fees). You can participate in charity gambling as long as you are at least 18 years old.

The Kansas Lottery has been selling tickets since 1987.

It made history by forming the Multi-State Lottery Association and offering Lotto America (later Powerball) with a few other states.

Today, it provides several in-state games and two multi-jurisdictional games (Powerball & Mega Millions).

Social Gaming at Home

Unlike most states, Kansas does not carve out an exemption for social gambling in its penal code.

Therefore, social gaming is technically illegal in the Wheat State. However, small games are unlikely to face legal troubles provided nobody banks the action.

The only gambling raids I have seen involve illegal gaming machines.

Poker Rooms and Clubs

You can enjoy live poker at Hollywood Casino, which features 12 tables for poker play.

Sports
Betting

Retail and online sports betting have been legal in Kansas since May 2022.

The commercial casinos Boot Hill, Hollywood, Kansas Crossing, and Kansas Star all have betting licenses.

They can each offer a retail sportsbook and up to three betting sites.

The Prairie Band Potawatomi recently amended their gaming compact to allow for sports gambling at the Prairie Band Casino.

Kansas Gambling vs. Neighboring States

Kansas and its neighbors have the same stances in almost every major gambling category. They all offer land-based casinos, lottery games, social gaming, and the same minimum gaming ages (18 – 21).

The only differences include Missouri and Oklahoma not offering legal sports betting. The following table shows a quick glance at the minor differences between Kansas and bordering states.

A Brief History of Kansas Gambling

The modern Kansas gambling history began in 1986 with a vote on the lottery. It has since seen plenty of milestones, which you can read below.

  • 1986 – Voters approve an amendment to allow lottery games; the Kansas Lottery goes live the following year.
  • 1987 – Voters okay pari-mutuel betting, creating the Kansas Racing and Gaming Commission and allowing wagers on dog and horse races.
  • 1989 – The Woodlands racetrack and Eureka Downs become the first KS tracks to accept pari-mutuel bets.
  • 1995 – Gov. Bill Graves and the state’s four federally recognized tribes agree to gaming compacts.
  • 1996The Kickapoo Tribe opens the first Kansas tribal casino called the Golden Eagle.
  • 2006 – The Kansas Expanded Lottery Act (SB 66) passes and permits commercial casinos and racinos.
  • 2008 – Woodlands racetrack closes despite the racino law passing, marking the end of KS pari-mutuel betting.
  • 2009 – Boot Hill (Dodge City) becomes the first Kansas commercial casino to open.
  • 2011 – Kansas Star Casino launches in a temporary complex, moving to its permanent location in Mulvane the following year.
  • 2012 – Hollywood Casino (Kansas City) opens at the Kansas Speedway.
  • 2015 Daily fantasy sports become legal in the Sunflower State through HB 2155.
  • 2017 – Kansas Crossing (Pittsburg) becomes the final KS commercial casino to open.
  • 2022 – Gov. Laura Kelly signs SB 84, officially legalizing retail and online sports betting in the Wheat State; she later places the state’s first bet at Hollywood Casino.
  • 2023 – The Prairie Band Potawatomi Nation negotiates its compact to become the first KS tribe to offer sports betting.

Responsible Gambling Initiatives

Despite its small stature, the Sunflower State has one of the country’s strongest networks for responsible gaming.

The Kansas Lottery and Kansas Coalition on Problem Gambling launched the Kansas Responsible Gambling Alliance in 2008.

The Kansas Prevention Collaborative is another resource for those seeking help with gaming.

Summary: Kansas’s Gambling Journey

Kansas got a late start with gambling, waiting until 1986 to legalize lottery games. However, it has quickly added other legal bets, including bingo, casinos, pari-mutuel, poker, raffles, and sportsbooks.

The Sunflower State approved its first form of online gambling through sports betting in 2022. It has not made any serious efforts to regulate online casinos and poker.

This trend is common among many states, which are mainly concerned with legal retail and mobile betting.

I could envision Kansas looking at regulated online casinos within the next 5-10 years. Offshore casinos and poker rooms will fill the void until any further online gambling legislative efforts.

Frequently Asked Questions

The Kansas gambling market has inspired some common questions among players. You can see the most popular FAQs below.

Is there any risk of playing at online casinos regulated outside of Kansas?

As long as you choose reputable brands, playing at online casinos regulated outside of Kansas has little to no risk.

Who regulates online casinos in Kansas?

The Kansas Racing and Gaming Commission regulates KS commercial casinos. However, no such in-state regulatory body exists for offshore online casinos.

These gaming sites hold licensing in foreign jurisdictions like Panama and Curaçao. Therefore, you must choose reputable online casinos to ensure fair treatment.
