Delaware Gambling Laws: A Deep Dive

Delaware was one of the first states to accept and regulate all forms of gambling.

There are a few restrictions on some types of wagering, but Delaware is generally considered a legal pioneer in betting.

The Delaware Lottery and the State Division of Gaming Enforcement regulate most forms of gambling. The Board of Charitable Gaming oversees bingo, raffles, and other charitable games.

Land-Based Casinos

Delaware is home to three casinos, or “racinos,” named so because they are located at race tracks.

The facilities started operations with slots but added table games and other games as the law changed.

They all now have the games and floor space of many standard casino operations. None are considered resorts, but one has a hotel, and another has a golf course.

All operate under Chapter 48 of the Delaware Code and are regulated by the State Lottery and the Division of Gaming Enforcement.

Horse & Dog Tracks

The state has three pari-mutuel harness and thoroughbred race tracks that run seasonal meets throughout the year.

The most notable track is Delaware Park, which hosts graded stakes thoroughbred races and is unique for its Arabian breed races.

Dover Downs and Harrington are primarily harness racing sites. Dover is unique because it has an auto race track hosting NASCAR events.

The tracks also host simulcast race wagering. Betting at all tracks comes under Chapter 101 of the state code and is regulated by the Delaware Department of Agriculture Thoroughbred Racing Commission.

There are no dog race tracks in the state.

Bingo, Lottery, and Charitable Gambling

Bingo is a popular activity in Delaware, with more than 20 communities, towns, and cities hosting bingo halls.

The halls range in size, so that the game prizes may vary. But the law calls for no more than a $350 prize for a single game and a total giveaway limit of $3,000 per session.

Some halls also carry pull-tab games and purchased tickets in which concealed spots are uncovered to reveal winners. They are all considered charitable games.
